Terms & Conditions

1. Free Travel Offer is valid only to legal residents of the 50 United States and the District of Columbia and who are of the legal age of majority in their state of residence. Void where prohibited. Listing agents are not eligible for this offer, even if representing buyer.

2. This offer is effective for purchases which close between June 1, and December 31, 2008 (“Offering Period”). Only buyers of a lot (minimum size: 12 acres) at Rim Rock Ranch “RRR”) located in Lake County, CA and who close escrow and take title within 60 days of signing the purchase agreement are eligible for the $5,000 Free Travel Offer. Buyer may elect to receive $5,000 which will be credited in escrow toward the purchase price of the minimum size lot at RRR, in lieu of the free travel offer. This offer only applies to purchase of the remaining unsold phase one parcels, i.e., lots 2 through 14.

3. Only one free travel voucher will be awarded for each purchase of a minimum size lot during the Offering Period that closes escrow within 60 days of the signing the purchase agreement. The free travel voucher will be awarded in the name of the individual[s], company or corporation whose name appears on the title. All claimants will have one year from date of issuance of the award in which to use their free travel voucher; all travel arrangements must be made through Sponsor’s agent. Travel is good on any airline, cruise line or hotel. At the expiration date of the award, any unused monies will be forfeited.

4. The Sponsor reserves the right, at its sole discretion, to disqualify any claims that do not comply with the guidelines established in these Terms and Conditions.

5. The Sponsor reserves the right to change or terminate this offer at any time and for any reason without advance notice, and at its sole discretion, reserves the right to interpret the terms and conditions of the program. All decisions by the Sponsor are final and binding; Sponsor is not responsible for typographical or printing errors in any of the materials relating to this offer.

6. Additional terms:

(A) By participating in this offer buyers agree to release, indemnify, and hold harmless the Sponsor against any injuries/losses/damages/claims/actions and any liability of any kind resulting, in whole or in part, directly or indirectly, from participation in this offering or acceptance, possession, use, misuse or nonuse of the travel voucher (or any travel/activity related thereto). This offering and terms and conditions shall be interpreted in accordance with the laws of the State of California without regard to its principles of conflicts of law. Jurisdiction and venue shall be solely within Santa Clara County, California.

(B) Buyer is responsible for obtaining all travel documents and travel insurance (and all other forms of insurance) they may wish to obtain (at their own expense) and hereby acknowledges that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.

(d) As a condition of participating in this offer, the participant a) hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses, b) all causes of action arising out of or connected with this offering, shall be resolved individually, without resort to any form of class action, and c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred and in no event shall buyer be entitled to receive attorneys’ fees or other legal costs.
